Justice Ali Mohammed Magray of J&K High Court Jammu wing today directed the State Vigilance Organisation Jammu (VOJ) to submit status of the progress of enquiry on affidavit on or before August 1, 2013 regarding alleged double drawal of Petrol, Oil, Lubricants (POL) by the vehicles attached with the Deputy Chief Minister (DyCM).
The direction came in a petition seeking quashing of order dated July 22, 2013 passed by the Special Judge Anti-Corruption Jammu granting four months time to State Vigilance Organization for completion of verification of preliminary enquiry in alleged double drawal of POL by the vehicles attached with Deputy Chief Minister.
Earlier, SSP Vigilance Organization Jammu Shakti Pathak and DySP (Investigating Officer) Jeetan Ji Mattoo appeared along with record and CD file before High Court as per the direction issued on July 25, 2013.
Justice Magray, after hearing S S Ahmed appearing for the petitioner and AAG Ravinder Sharma appearing for the respondents and also after perusal of record, observed the record revealed that State Vigilance Organization Jammu had undertaken process of enquiry in the year 2012. Justice also directed the respondents to submit status of the progress of enquiry on affidavit on or before August 1, 2013.
In the petition, it was submitted that the petitioner, on having specific inputs about the alleged misuse of government vehicles by Deputy Chief Minister of the state Tara Chand and his Personal staff, decided to obtain the information through RTI and petitioner lodged RTI applications to Housing & Urban Development Department, JMC, J&K State Motor Garages, J&K Housing Board, JDA, Director Urban Local Bodies Jammu & Srinagar, SDA, SMC, Lakes and Waterways Development Authority, Srinagar and IG Security J&K which were under the control of the then Minister for Housing & Urban Development department i.e. Deputy Chief Minister Tara Chand.
“In all applications, the petitioner had sought the information as to how many vehicles had been placed at the disposal of Deputy Chief Minister and from which date the said vehicles were deployed with him and the petitioner also sought the copies of the letter issued by Personal Section of Deputy Chief Minister requesting for POL,” it was stated the petition.
The petitioner also prayed for constitution of Special Investigation team which would be monitored by the J&K High Court till the completion of the investigation.
The petitioner also sought direction to respondent to constitute a Special Investigation Team under the direct supervision of Director J&K Vigilance Organization comprising officers having impeccable integrity in order to prove the petitioner’s complaint dated September 14, 2012 seeking direction against Deputy Chief Minister of State and the Personal Staff/Section regarding double drawl of POL so that the confidence could be instilled in the fairness of the probe.
In the petition, the petitioner sought that the High Court should monitor the entire preliminary enquiry till its completion.
